COPYRIGHT COMPLAINTS

Notification and procedure for complaints about copyright violations.
If you think that your material has been copied in a way that violates your copyright, send a written letter to the representative of Villa Scapone s.r.l. This procedure will only be validated if a written letter has been sent to Villa Scapone s.r.l. and his affiliates about copyright violation.

A valid notification should contain:
1.        The signature of the authorised person on behalf of the owner of the copyright that has been violated;
2.       The ID of the subject protected by copyright, or more than one subject protected by copyright that has been violated and present on a website, to be listed if more than one;
3.       The actual material contested in the violation that has been removed or disactivated, however it has to contain enough information to identify such material;
4.        Contact details including e-mail address;
5.        A statement that with all good means specifies the material used is not authorised by the copyright holder, one of his representative or the law.
6.        A last declaration with accurate information and a confirmation that the acting part is authorised by the copyright holder for the exclusive right that has been violated; failure to do so can incur a false witnessing in court.
When a notification has been received containig all 6 points as above::
1.        The service supplier must remove access to the material allegedly copied;
2.        The service supplier must notify the person possibly responsible of the violation (member);
3.        The service supplier has to proceed to notify immediatly the member that access to the material has been removed or disabled.

Renotification
For an effective renotification to the responsible of service supply please include:
1.       Signature of the member;
2.       Identified material that has been removed and location of the material befor its removal;
3.      A genuine declaration from member saying that the material has been removed due to an error of identification.;

When the renotification has been received with the above criteria:
1.      The service supplier has to provide a copy of the renotification to the owner;
2.      The service supplier has to inform the owner that he intends to reinstate $access to the material within 10 working days;
3.      The service supplier should reset the access to the materials within 10 working days or 14 working days after receiving renotification if the representative of the supplier has not received notice of legal action about copyright violation.

GENERAL CONDITION OF BOOKING
These terms of booking, toghether with general terms of use above mentioned and the privacy policies about the booking, are the basis of your contract with Villa Scapone s.r.l. We invite you to read carefully the contents of this document explaining rights and obligations. By booking, the person who actually books is considered the leader of the group and he confirms to be authorised by the rest of the group to comply with the booking conditions. The leader is responsible for the payment due to us. We will confirm your booking (if available) by sending an e-mail or by post. Please check carefully all details of the booking and contact us in case it does not respond to your requirements, so it can be changed immediately. In this general conditions the terms ‘you’, ‘your’, refers to all names in the booking (including ones added or changed).The terms ‘we’, ‘ our’ refers to Villa Scapone s.r.l. The term ‘supplier’ refers to the third party that can give transport services, hotelliere or any other service provided by yourself.

1. YOUR BOOKING
By booking, the person who actually books is considered the leader of the group and he confirms to be authorised by the rest of the group to comply with the booking conditions. The leader is responsible for the payment due to us. We will confirm your boking (if available) by sending an e-mail or by post. Please check carefully all details of the booking and contact us in case it does not respond to your requirements, so it can be changed immediately.

2. PAYMENT
In order to validate your booking we need a way to secure your payment. If a payment is not made in the requested time we will consider the booking as cancelled by yourself. In this case you could be prosecuted as is explained in point 6 of this document.

3. YOUR CONTRACT
When we send you the booking confirmation we have a contract. The contract is your booking, and it is subject to the Italian laws, so any dsputes will be supervised by the law.

4 .THE COST OF YOUR STAY
Ci riserviamo il diritto di aumentare o diminuire le tariffe in qualsiasi momento. Il prezzo del vostro soggiorno sarà comunque confermato al momento della vostra prenotazione.
Dal momento in cui la vostra prenotazione viene confermata (soggetta comunque ad errori ed omissioni), il prezzo del vostro soggiorno non sarà aumentato/non subirà variazioni.
Ci riserviamo il diritto di correggere eventuali errori, sia nel prezzo pubblicizzato, sia in quello confermato. Aggiorneremo i prezzi nel momento in cui verremo a conoscenza dell’errore stesso.
Vi preghiamo di notare che errori e modifiche possono occasionalmente avvenire. Vi consigliamo di controllare il prezzo del soggiorno da voi scelto al momento della prenotazione.

5. CHANGES MADE BY YOU
If you would like to change your booking you need to notify us as soon as possible.We will do our best to help you but that does not mean you will be able to fully respond to your changes. When we are able to change your booking this operation will be cosidered a cancellation so a new booking will be charged on your bill with consequent fines as reported in article 6.

6. YOUR CANCELLATIONS
In the case of one participant of the group not being able to attend the stay, then the leader must let us know immediatly. Your cancellation will only be valid if forwarded to our booking centre or through our website www.villascapone.it. In such occasion you will receive an ID number of such operation with time and date. We suggest you keep this record for future reference. In case the cancellation has been made by you, terms of free cancellation apply as explained on your booking document, you will only incur a penalty paying for the first night of the stay. There are other tariffs about cancellation fees including the whole amount of the stay. Penalties will be communicated to you on the booking confirmation.

7. CHANGES AND CANCELLATION MADE BY US
We plan our tariffs and offers months in advance. Occasionally we have to make adjustments on our website, sometimes before we confirm bookings, sometimes after. It’s in our intrest to avoid such changes or cancellations, but when they occurr we have the right to make them. The majority of the changes are not very significant, occasionally they are. In this case we will contact you as soon as possible. If there is sufficient time to make arrangement before the start of your stay we propose to you the following:
(a) (for significant changes) Accept these changes
(b) an alternative stay with similar standard and conditions, or even superior
(c) cancel or accept the cancellation, in this case any payment made to us will be refunded. Please note that the alternatives listed above are for minor changes only.

Please note that the alternatives listed above are for minor changes only. Exeptions are made to room-only bookings, that means that you will be refunded if changes or cancellations are needed, but these conditions apply: (1) we are forced to cancel or modify significantly the package because of exeptional events, wich are out of our control, that have consequences that we cannot avoid even with the best of our attention, or (2) we did not reach a sufficient number of guests from your group- in this case you will be warned 7 days prior to your arrival (the minimum number of guests is specified in the package).If you make an error on your booking form resulting in cancellation, you will not be refunded, as specified in these terms and conditions, so we are authorised to act this way (for example, late payment). In any case, our responsibilities for changes or cancellations are limited but, where applicable, we will refund or compensate. We are not responsible for any expense or loss due to the change or cancellation. No compensation is given for small modifications or cancellation of booking for your stay. Rarely for ‘major reasons’ ( see point 9) we have to stop or cancel your booking. This situation is really remote but in such case we are not to give any refund.

8. MAJOR CAUSES

With exeptions, previously documented, we are not responsible for any extras consumed by you, or if we are unable to deliver our services due to major causes. Major causes are events that are inevitable for us or our suppliers. Those events are: war, civil war, terrorist attacks, natural or nuclear disasters, fire, extreme wheather conditions and strikes.

9. OUR RESPONSIBILITY TOWARDS YOU
We intend to assure you that all the services included in your booking are delivered with the highest level of care.We will be responsible if the service not delivered depends on us or on our staff or by our reservation agents. It is up to you to bring to our attention that there is a fault in our service by making a complaint. We are not responsible for sickness, injury, death or any loss of personal belongings, damage, or extra costs for any of the following:
(a) if the person responsible of the act cannot be found;
(b) if a third party not connected directly with the service can’t be blamed;
(c) if because of an event that us or one of the suppliers couldn’t avoid;
(d) for a disservice caused by a party not directly connected with the service. However we will not be responsible if you did not enjoy your stay because of a special requirement that has not been comunicated by you on the booking time. In particular, we are not responsible for any service that is not included in the contract.

10. COMPLAINTS
In case you have a complaint to make, you need to contact the supplier. Any verbal complaint has to be written and sent to the supplier. If we don’t know about a problem we are unable to solve it for you. Many problems are solved quickly. However if you are not satisfied you can write to the Villa’s GM or to our customer care office- Villa Scapone- Litoranea Mattinata-Vieste Km 11,5 71030 Mattinata (FG)- info@villascapone.it, within 28 days prior to the end of your stay, reporting the booking confirmation number and the complaint. In the case that health problems are involved we are unable to accept any complaint unless previously notified.

11. BEHAVIOUR

At booking time, you accept all responsibilities for any damage or loss caused by any of the participants including yourself. An immediate full payment will be requested if damage to the premises occurs. You may be taken to court if you don’t apply to this and you will be charged for our legal fees as well.

12. GENERAL CONDITIONS FOR SUPPLIERS
Many of the services present in your stay are depending on private suppliers. They offer services at their own terms and conditions. If these terms and conditions are required by you, you can inform Villa Scapone s.r.l. or the supplier itself.

13.SPECIAL REQUEST AND HEALTH REQUIREMENTS
Please specify in your booking if you have any special requirements. We will do our best to satisfy these demands, as long as they are reasonable; we can’t guarantee that every demand will be granted unless stated in writing by us. You will have a written confirmation in case your request is very important to you. All requirements are subject to availability. All the bookings are treated as standard so if we are unable to satisfy your requirement we will regretfully reject such bookings. If you feel that you or a member have health problems that could compromise your stay, we advise you to let us know when you process your booking. If we feel that we can’t satisfy your requirements we reserve the right to decline your booking, if this information has not been brought to our attention it will not be considered by us.

14. TRAVEL DOCUMENTS
You are responsible for your travel documents and vouchers. If cancellation occurs due to expired or invalid documents, you are not entitled to a refund, including extra expenses.

15 FINANCIAL SECURITY
With exeptions to money payed on the booking, related to your stay at the Villa, all money given to us will be stored in a bank account until the end of your stay or until such money will be refunded to you. This means that you will be refunded if, from our side, there are problems that are compromising your holiday.

GENERAL INFORMATION
All the information on our website is updated when published. Our descriptions refer to the activities available in the area that you are visiting.We are not responsible for those activities because they are not supervised by us. Such activities are owned by privates.We are not responsible for activities not included in the contract even if we suggested on booking time. As a consequence, we are not responsible for any related activity and the responsibility accepted by us (see Chapter 9) does not apply to them. We can’t guarantee that such information relating to activities is correct because they are not controlled by us. If you feel that these activities, not included in our contract, are important to you for the full enjoyment of your holiday, then write to us, so we can give you updated information. Also if you feel that the information about the area or activities are altered, and crucial for the choice of your holiday, please let us know when you book.
